On Episode 74 of Going Rogue with Lara Logan, former IRS Special Agent Joseph Banister explains what he believes is the starting point of income tax withholding in America.
Banister points to the W-4 form, describing it as a voluntary withholding agreement between employee and employer, not a direct contract with the IRS. He argues this is the moment where workers authorize money to be taken from their paycheck.
He explains that once an employer withholds those funds, they are legally required to send that money to the government, calling it a “trust fund” obligation.
Banister also breaks down the difference between W-2 employees and 1099 contractors, noting that in both cases the IRS still receives income records regardless of whether an individual files a return.
He further claims that many 1099 forms are not legally required and are often filed by businesses as a precaution.
Lara challenges him directly, pressing on whether opting out is realistic and what the risks could be for everyday Americans.

Whistleblower Tarek “Joey” Kadourah says Americans need to understand the role the federal government played in what he describes as the trafficking of migrant children.
Kadourah, who worked as a site supervisor for a federal contractor handling unaccompanied children in 2021, tells Lara Logan that what he witnessed was not simply a failure of the system. He says children were being moved through a government process and released into situations that, in his experience working around child trafficking, showed clear signs of exploitation.
“This is all true. It’s not allegations or hearsay. And I know child trafficking.”
